1.) Who these terms are with

This website is operated by Attard & Co. Wines & Spirits, Canter House, P. Felicjan Bilocca Street, Marsa MRS 1524, Malta. “We” and “us” mean that company; “you” means anyone using the site.

By browsing this site, opening an account or placing an order you accept these terms. If you do not accept them, please do not use the site.

2.) You must be old enough to buy alcohol

We sell alcohol. You may not use this site to buy it unless you are old enough to do so under Maltese law, and you must not buy it on behalf of anyone who is not.

The notice shown when you arrive asks you to confirm your date of birth. We may ask for proof of age on delivery and may refuse to hand over an order without it. An order refused for that reason may be returned to us, and we may charge the cost of the failed delivery.

3.) Your account

You are responsible for keeping your password to yourself and for anything done through your account. Tell us straight away if you think someone else has used it.

We may suspend or close an account that is being used in breach of these terms, or to buy alcohol for someone under age.

4.) Orders

Everything on this site is an invitation for you to place an order, not an offer. A contract is only formed when we confirm that your order has been dispatched, not when you place it and not when you receive an acknowledgement.

We may decline an order — for example where the item is out of stock, where we cannot verify your age, where the price or description was wrong, or where we are not able to deliver to you. If we decline an order you have already paid for, we refund it in full.

5.) Prices and payment

Prices are shown in euro and include VAT at the rate applying on the day of your order. Delivery is charged separately and is shown before you confirm.

We take reasonable care to price the site correctly, but if an item is obviously mispriced we will tell you before dispatching and you may confirm the order at the right price or cancel it.

6.) Delivery

We deliver to the address you give us, within the times shown at checkout. Those times are estimates and not guaranteed.

Risk in the goods passes to you on delivery. Someone of legal drinking age must be present to accept an order containing alcohol.

7.) Cancelling and returning

Nothing in these terms affects your rights as a consumer under Maltese and EU law, including your right to cancel a distance purchase within the statutory period.

Our own returns arrangements are set out in our [Refund and Returns Policy — link once it is finalised]. Some goods cannot be returned once opened, and we will say so before you buy.

If something arrives damaged or is not what you ordered, tell us within a reasonable time and we will put it right.

8.) What is on the site

We take care over the descriptions, images and vintages shown, but labels, bottles and vintages change. The product you receive may differ slightly in packaging from the photograph. Where a vintage matters to you, please ask us before ordering.

Nothing on this site is a recommendation to consume alcohol, and nothing here is health advice.

9.) Our content is ours

The text, photographs, logos and design of this site belong to Attard & Co. Wines & Spirits or to the producers whose brands appear on it, and are protected by copyright and trade mark law. You may look at the site and print pages for your own use. You may not copy, republish or use any of it commercially without our written permission.

10.) Things we are not responsible for

We do not exclude or limit our liability where it would be unlawful to do so — including for death or personal injury caused by our negligence, or for fraud.

Subject to that, we are not liable for losses that were not foreseeable, for losses arising from your own breach of these terms, or for business losses. The site is provided as it is; we do not promise it will always be available or free of error.

11.) Links to other sites

Where we link to a producer or another site, that is for information. We do not control those sites and are not responsible for their content.

12.) Privacy

How we handle your personal data is set out in our Privacy Policy, which forms part of these terms.

13.) Changes to these terms

We may change these terms. The version that applies to your order is the one published when you placed it. If we change them we will update the date shown at the top of this page.

14.) Law and disputes

These terms are governed by Maltese law, and the courts of Malta have jurisdiction. If you are a consumer resident elsewhere in the EU, you keep the protection of the mandatory rules of your own country.
